ORDERING

By completing a Purchase Order, You are making an offer to purchase the Product at the price set out in the Website. Payment must be made at the time of submitting the Purchase Order. Payment can be made by credit card. You warrant that you are an authorised user of the credit card used to complete payment in accordance with this clause.

The Purchase Order must pay the full purchase price (including any GST) in full together with any other applicable fees or charges such as delivery charges. You authorise us to debit your credit card account for the total amount payable to us as a result of any purchases by you.

We reserve the right to alter prices at any time. If a product inadvertently appears on the website at the wrong price, we may decline or cancel any orders placed at the wrong price,

SHIPPING

Both Australia Post and Fast Way are used by Battle of Bosworth Wines as our carriers of choice. Please note that a full case of wine weighs more than 16kg. We recommend that you take extra care when lifting deliveries. If you have concern about the weight, we suggest you open your delivery and transfer bottles one or two at a time.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Battle of Bosworth Wines liability for breach of any implied warranty, condition or undertaking which cannot be excluded is limited, at the option of Battle o Bosworth Wines, to:

in the case of services, the supply of the services again or the payment of the cost of having services supplied again;
in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired.

You agree that Battle of Bosworth Wines liability, if any, to you at law will be reduced by the extent, if any, to which you contributed to the loss.

TERMINATION

We reserve the right to terminate this Agreement at any time. If the Product has not been delivered to you prior to any termination of this Agreement by us, we will refund to you any payment you have made prior to the termination.
